As tempers flared and large-scale protests broke out in June 2020 after the death of George Floyd, the heated discourse took center stage on social media. A member of the promo industry was fired after footage of him physically assaulting young Black Lives Matter supporters on a bike trail was posted on social media and went viral. While most personal expression about the issue was less extreme than that, there was still an outcry of support for (and opposition to) the protests spreading throughout our society. However, while millions were being moved to speak and post, there remains little understanding over what, when and how employees can express themselves. Can they express their views safely? Can companies fire them if they disagree with their views? In this in-depth article, Executive Editor Sara Lavenduski spoke with lawyers and business experts about the First Amendment in the private sector workplace and why it remains completely misunderstood among most Americans.
