In “How Badly Does it Hurt?” Kevin Davis reveals how neuroscience has begun creeping into the courtroom to support personal injury cases and pain and suffering claims. Pain is relative, something that only the person feeling it can really describe, and can be challenged in court. Personal injury lawyers often must battle to prove their clients are suffering from chronic and debilitating pain, and some have turned to neuroscience. Davis interviewed neuroscientists and researchers to better understand the promise and limitations of brain scanning, and lays out the complex science in an easy to understand narrative. Davis’ story separates fact from fiction, explaining how neuroscience can be used, or misused in the courtroom. He puts the story in perspective by pointing out that chronic pain is a national public health problem and a $600 billion industry with millions of disability claims at stake. Davis shows that neuroscience, if and when it’s ready, could offer evidence in cases where a patient is either faking pain, or really has it, a significant development for the legal world.
